1st November 1866

Know all men by these Presents that I John Cree Merchant in Glasgow being resolved to settle the succession to my means and Estate so as to prevent all disputes relative thereto after my death and Considering that by Antenuptial Contract of Marriage entered into and executed by and between me and Catherine Buchanan my present wife of date the 2nd day of April 1830 provision has already been made by me for her in the terms thereof...

... and for the love & Affection which I have and bear to my children after named and in implement of my obligation contained in said Contract of marriage to therefore truly Give Grant assign dispose convey and make over from me from and after the time of my death to and in favour of "Robert" "Thomas" "William" "James" and "Ann Jamieson" Crees children lawfully procreated of a former marriage between me and the deceased Janet Jamieson and "Sophia Stewart" and "John Buchanan" Crees children lawfully procreated of the said marriage equally among them share and share alike and failing any of them to be survivors...

... my Executors after my decease and the said Catherine Buchanan my wife John Jamieson Junior Merchant in Glasgow James Jamieson of the Royal Marine Service "Thomas Cree Manufacturer in Glasgow" "William Cree Manufacturer there", and failing any of them by death or now acceptance "Robert Cree Manufacturer in Glasgow" and "James Cree Merchant in Limerick"

...a sum sufficient to produce an Annuity of £60 Sterling per Annum be laid aside and invested in any way considered most prudent for the use and support of Susan Wylie or Cree wife of my son William Cree during her lifetime, which sum is to be retained and abducted from the amount which may fall to the said William Cree my present eldest Surviving son by my foresaid Will and Testament and over this said Annuity my son William is to have no Control this I do written by own hand this 3rd day of October one thousand eight Hundred and fifty five continued on page 6th (signed) John Cree In continuation of Codicil of 3rd day of October of the year 1855 I further will that it would not be doing equal justice to the other part of my family to make them suffer the entire loss of my son Williams loss in Business in the Island of Trinidad whether from misfortune or negligence I will therefore that the £1500 given him to commence business be deducted from his proportion of my Estate, this sum was not... .I hereby cancel (signed) John Cree - Codicil - I John Cree Merchant in Glasgow having made my Testament on the 23rd day of October 1832 I refer thereto, but owing to changes in my family and other circumstances do to the propriety and need of the following Codicil... I have at the present time three daughters "Sophia" "Elizabeth" and "Catharine" I hereby will that any money or effects coming to them or to any daughters I may leave at my death by the foresaid will shall be settled in the event of marriage on themselves and their families independent of their respective Husbands, this I do seeing the necessity of it... I also will that to retain Bullwood Cottage in the family as a place of healthful retreat...

Glasgow 11th April 1859. In Consequence of the death of my wife Catharine Buchanan on the 21st of last month I hereby cancel that part of Codicil of 31st August 1843 which relates to the cottage in Bullwood and will that it or proceeds thereof go to be distributed same as all other property among my family (Signed) John Cree - ... explanatory clauses 28th November 1863 - my son James having deceased on the 11th of this present month of November leaving three children Viz "James John" "Alice Rose" and "Charles" Cree to satisfy his widow now particularly limitation my will is that these three children become as they really are Heirs to their father and share alike each whatever of my Estate would have fallen to him had he survived me this written by my own hand on the above date 28th Novr 1863 (signed) John Cree. Explanatory Clause 27th January 1864. The Thousand pounds left me in liferent to go to my first family at my decease does not appear in my Books I only took Credit for the interest when received only two of that family being alive when William the eldest assigned over his and half to his Brother James to enable him to settle One thousand pounds on his marriage on his intended wife Miss Alice Fanny Strachan in event of his death which having taken place and she in possession of said thousand pounds it becomes proper and fair that William may not lose by his liberality to his brother James that £500 of my Estate may be deducted from James' share and given to William this appearing to me honest and fair I will it to be so the above written by my own hand this 27th January 1864 (signed) John Cree The Thousand pounds alluded to above left me by John Jamieson Esquire Largs (signed) John Cree
