James Cree

James Cree was born on 29 March 1831 in 5 Dunbar Street, Edinburgh, Midlothian, Scotland.1,2 He was the son of James Cree and Isabella Henderson.

On 6 June 1841 James Cree was living in the household of James Cree and Isabella Henderson in Buccleugh Street, St Cuthberts, Edinburgh, Midlothian, Scotland, along with Thomas Cree, William Cree, Henry Cree, Christian Cree and Andrew Cree. James was a "working mason." His eldest son Thomas aged 20 was a tobacco spinner, William aged 15 was a journeyman mason and Henry, also 15, as an apprentice mason.3

ACCUSED BEFORE THE CITY COURT. I
The outbreak of larrikinism at North Melbourne on Saturday night was yesterday brought under the notice of the City Police Court. Mr. Panton, P.M., and a bench of justices gave a patient hearing to the case.

The details of the outrage were given in The Argus of yesterday, and the evidence taken during the hearing of the case fully bore out their accuracy.

The accused were listed as John Coghlan, George Coghlan, and James Orr. It came out in evidence, however, that they were three brothers, named respectively John Cree, George Cree, and James Cree. The first was charged with behaving in a riotous manner, and also with unlawfully assaulting Constable Fallon in the execution of his duty ; the second was charged with inciting a prisoner to resist Constable Fallon, and with unlawfully assaulting that officer in the execution of his duty ; and the third was charged with Inciting a prisoner to resist Constable Fallon, and with unlawfully assaulting Constable Myan in the execution of his duty, and further with breaking a pane of glass, value 10s., the property of the Victorian Government.

The evidence of Constables Fallon and Ryan, of Mr. Walker, manager ot the West Melbourne Coffee Palace, and of a tramway gripman named George Poll was conclusive with regard to the assaults with which the accused were charged.

The accused George Cree asked for a remand for a week, in order that he and his brothers might make arrangements with their widowed mother to carry on their affairs during their absence, and also to raise the money to pay expenses if they should be fined.
Mr. Panton, P.M.-You ought to have thought of that before behaving in such a blackguardly, cowardly manner.

For behaving riotously, John Cree was fined 20s, or seven days' imprisonment, and for the assault on Constable Fallon he was fined £3, or 14 days' imprisonment. For inciting a prisoner to resist the police, George Cree was sentenced to imprisonment for one week, and for assaulting Constable Fallon he was sentenced to two months' imprisonment without the option of a fine, the sentences to be cumulative. For inciting a prisoner to resist the police James Cree was sentenced to one month's imprisonment, and for the assault on Constable Ryan he was sentenced to two months' imprisonment without the option of a fine, the sentences to be cumulative. For smashing the window of the watch house he was fined 10s., with 10s, damages, or three days' imprisonment.

The Bench warmly commended the witnesses Messrs. Walker and Poll for tho assistance they had rendered the police while the latter were struggling against heavy odds.

We cannot identify them because five Cree children died aged 5 and under in Auckland Reg Dist between 1891 and 1911. The five were George, Russell, William, Margaret and Austin Cree.4,5

His son Private John Cree was born c 31 January 1897 in Shildon, County Durham, England.6,7

On 31 March 1901 William Cree and Elizabeth Jane Askew were living in 18 Adelaide Street, New Shildon, Shildon, County Durham, England, along with Private John Cree. William was a wood machinist (or sawyer) born in Durham and aged 32. Elizabeth was 30 and born in Shildon. John was 4 years old. It seems that William worked "at home."8

On 2 April 1911 William Cree and Elizabeth Jane Askew were living in 11 Craddock Terrace, New Shildon, County Durham, along with Private John Cree. William was a wood machinist at the NER Wagon Works and was 42 years of age. Elizabeth was 40 and had had three children of whom two had died. John, aged 14, was a messenger employed at Smith & Sons, cleaner and dyers, Bp Auckland.9

On 7 April 1861 Mary Hutchison was living in Baldridge Burn, Dunfermline, Fife, Scotland, along with Isabella Cree, David Cree and Isabella Thomson. Mary was aged 60, her daughter Isabella Cree was 27 and a cotton weaver. Mary's grandson David Cree, Isabella's son, was aged 2. Isabella Thomson aged 6 was a boarder in the household.13

Mary Hutchison died on 25 December 1881.14

In 1905 Robert Cree moved from Askham in Furness and settled at Bisbee, Arizona, USA. He was travelling with three other miners from the Askam district to Bisbee, Arizona, where copper mining was expanding rapidly. They were John Myers, John Quayle and Sidney Blake. John Myers already had a cousin at 40, Tombstone Canyon, Bisbee, and John Quayle had a father and brother there. They set sail from Liverpool on board the SS Teutonic on 11 October 1905 and arrived in New York on 19 October.3

Margaret Lockhart married Andrew Cree, son of Andrew Cree, on 9 April 1894 in Belfast, County Antrim, Ireland. Andrew Cree was a miner and a widower resident in England. He signed with his mark. Margaret Lockhart was a spinster.2

Her daughter Ellen Isabella Cree was born c August 1896 in Askam in Furness, Lancashire.3,1

Her son Andrew Cree was born c November 1897 in Askam in Furness, Lancashire.1,4
